CHAPTER NO. 2309 AN ORDINANCE AMENDING CHAPTER 165, ZONING REGULATIONS, OF THE CITY OF CLINTON, IOWA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA: Section 1. Purpose. The purpose of this ordinance is to amend the Zoning Regulations of the City of Clinton, Iowa. Section 2. Amendments. The following section of Chapter 165 is amended to read as follows: Amend Section 165.14A by adding the following subsection: 4. “Main Avenue” Overlay Zone. The Main Avenue Overlay Zone is intended to protect and promote the area as a neighborhood commercial shopping area. A. Zone designation. The Main Avenue Overlay Zone shall be designated on the official zoning map by ordinance. The Overlay Zone includes those properties near or abutting the Main Avenue Corridor from North 3rd Street to McKinley Street. B. Applicability. The requirements of this Section shall apply to all building construction/reconstruction, renovation, and use of land within the Main Avenue Overlay Zone. C. Use regulations. Permitted uses in the Main Avenue Overlay District shall be those listed in Section 165.12 “C-2” General Commercial District with the following exception: (1) Residential uses are only permitted above the first floor. D. Height and area requirements. The height and area requirements for Section 165.12 shall be observed. E. Parking and loading. Parking and loading requirements for Section 165.12 shall be observed. F. Signs. Sign regulations for Section 165.12 shall be observed. Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 5. Effective Date. This ordinance shall be in full force and effect from and after its adoption and publication as provided by law. ______________________________ LaMetta K.
