CHAPTER NO. 2307 AN ORDINANCE AMENDING CHAPTER 165.02 OF THE ORDINANCES OF THE CITY OF CLINTON, IOWA, BY CHANGING THE ZONING CLASSIFICATION OF PROPERTY LOCATED SOUTH OF THE INTERSECTION OF NORTH 18 STREET AND MILL CREEK PARKWAY WITHIN THE CITY OF CLINTON, IOWA, FROM R-1A (SINGLE FAMILY RESIDENTIAL) TO C-1 (LOCAL COMMERCIAL). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA: Section 1. Amendment. Chapter 165.02 of the Ordinances of the City of Clinton, Iowa, classifying real estate described as follows: Commencing at the center of Section 2, Township 81 North, Range 6, East of the 5th P.M., thence south 87°45’35” west, a distance of 50’ to the west right-of-way line of North 18 Street, thence north 2°14’25” west along the west right-of-way of North 18 Street a distance of 705.69’ to the point of beginning; thence north 2°14’25” west along the right-of-way line a distance of 407.50’, thence north 16°36’58” west, 198.19’, thence north 48°46’08” west, 184.93’, thence south 30°09’00” west, 311.93’, thence south 33°39’12” west, 265.95’, thence south 18°50’47” west, 335.00’, thence south 23°10’56” west, 310.42’, thence north 82°11’09” east, 183.85’, thence south 86°42’36” east, 80’, thence north 51°06’24” east, 390’, thence north 58°49’50” east, 211.06’ to the point of beginning Is hereby amended so that said real estate is classified in the C-1 (Local Commercial) zoning district. Section 2. Site Development Plan. The proposed use of the above described property shall be in compliance with the Site Development Plan, which was approved by the City Plan Commission on October 26, 2005. Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
