CHAPTER NO. 2306

 AN ORDINANCE PROVIDING FOR THE VACATION AND CONVEYANCE OF THE WESTERLY 16-FOOT BY 125-FOOT PORTION OF THE EAST/WEST ALLEY IN THE 2000 BLOCK OF PERSHING BLVD. TO TIMOTHY SCHULTHEIS FOR $500

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA:

Section 1.       Purpose.   The purpose of this ordinance is to vacate and convey the described streets and alleys, relieve the City of Clinton, Iowa of the responsibility for its maintenance and supervision, and place it on the property tax rolls.

 Section 2.  Facts Found  The Council of the City of Clinton, Iowa, finds that this alley is not needed for the use of the public, and  therefore, its’ maintenance at public expense is no longer justified.

 Section 3.  Vacation.   The property described as the westerly 16-foot by 125-foot portion of the east/west alley in the 2000 block of Pershing Blvd. is hereby vacated.

 Section 4.  Conveyance.  The property described as the westerly 16-foot by 125-foot portion of the east/west alley in the 2000 block of Pershing Blvd. is hereby conveyed to Tim Schultheis for $500 and other good and valuable consideration and the Mayor and City Clerk are hereby directed to sign a quit claim deed conveying said property.

Section 5.  Severability Clause.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

 Section 6.  Repealer.  Any ordinance or parts of ordinances in conflict herewith are hereby repealed.

 Section 7.  Effective Date.  This ordinance shall be in full force and effect from and after its adoption and publication as provided by law.
