CHAPTER NO. 2305 AN ORDINANCE PROHIBITING THE PARKING OF SEMI -TRACTORS, SEMI -TRAILERS, BOATS, RECREATIONAL VEHICLES, CAMPERS, MOTOR HOMES AND UTILITY TRAILERS ON THE STREETS IN THE CITY OF CLINTON BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA: Section 1. Purpose. The purpose of this ordinance is to prohibit the parking of semi-tractors and semi-trailers on streets and to prohibit boats, recreational vehicles, campers, motor homes, utility trailers and other large vehicles from parking on streets. Section 2. Parking of Semi-Tractors and Semi-Trailers Prohibited. No person shall park a semi-tractor or semi-trailer on any street in the City of Clinton, Iowa, except this section does not apply to trucks or trailers being used for the purpose of delivering or collecting goods, wares, merchandise or materials when such vehicles are parked for a period of time not longer than is necessary for the expeditious delivery or collection thereof, and in no event for a period of time to exceed two hours, except moving vans may be allowed to park between 8:00 o’clock a.m. and 8:00 o’clock p.m. for loading and delivery. Section 3. Parking of Boats, Recreational Vehicles, Campers, Motor homes and Utility Trailers Prohibited. No person shall park a boat, recreational vehicle, camper, motor home or utility trailer on any street in the City of Clinton, Iowa between 8:00 o’clock a.m. and 8:00 o’clock p.m. Said prohibition applies whether the boat, recreational vehicle, camper or utility trailer is attached to a motor vehicle or not. Section 4. Parking of Large Vehicles Prohibited. No person shall park a vehicle exceeding eight feet in height, eight feet in width or 20 feet in length on any street in the City of Clinton, Iowa, except this section does not apply to vehicles being used for the purpose of delivering services or delivering or collecting goods, wares, merchandise or materials when such vehicles are parked for a period of time not longer than it necessary for the expeditious delivery or collection thereof. Construction trailers are exempt from the requirement of this section, if they obtain a parking permit. Owners of construction trailers shall obtain a parking permit from the City Engineer’s Office. The permit will be valid for seven consecutive calendar days and will allow the parking of the construction trailer on the street in one location for that time period. After seven days, the construction trailer must be moved or another parking permit must be purchased. A copy of the parking permit must be attached to the construction trailer. The fee for the parking permit shall be set by Council resolution. Construction trailers shall be parked off street on private property if possible. Construction trailer parking is not exempt from calendar parking regulations. Section 5. Vehicles Ticketed and Towed. Any vehicle found in violation of Sections 2, 3, and 4 of this Ordinance shall be ticketed for the violation with a fine of $50.00. If the vehicle is still in violation 24 hours after the vehicle is ticketed, the vehicle shall be ticketed again, towed and impounded with the vehicle owner to pay the costs of towing and impoundment. Section 6. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 7. Repealer. Any ordinance or parts of ordinances in conflict herewith are hereby repealed. Section 8. Effective Date.
