CHAPTER NO. 2298 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF CLINTON, IOWA, 1999, BY AMENDING PROVISIONS PERTAINING TO SEWER RENTAL RATES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA: SECTION 1. MINIMUM VOLUME BILL FOR MONTHLY CUSTOMERS. Chapter 99, Section 06 of the Code of Ordinances of the City of Clinton, Iowa is amended by changing subparagraphs A.4, B.4, C.4, D.4, E.4 and F.4 to read as follows: 4. The minimum volume to be billed for each quarterly customer shall be 500 cubic feet per quarter and for each monthly customer shall be 167 cubic feet per month. SECTION 2. SEWER CUSTOMERS NOT AN IOWA AMERICAN WATER CUSTOMER. Chapter 99, Section 06 of the Code of Ordinances of the City of Clinton, Iowa is amended by adding to subparagraphs A, B, C, D, E and F the following new subparagraph 7: 7. Sewer customers who are not customers of Iowa American Water Company shall pay a charge of $72.00 per quarter. SECTION 3. PAYMENT PERIOD OF 20 DAYS. Chapter 99, Section 07 of the Code of Ordinances of the City of Clinton, Iowa is amended by changing paragraph 2 thereof to read as follows: 2. Bills Payable. Bills for sewer service are due and payable at the Office of the Clerk within 20 days of the date of issue. SECTION 4. PAYMENT PLANS AUTHORIZED. Chapter 99, Section 07 of the Code of Ordinances of the City of Clinton, Iowa is amended by adding a new paragraph 4 thereto to read as follows: 4. Payment Plans Authorized. The Finance Director is hereby authorized to establish payment plans for customers who qualify under guidelines established by the Finance Director. SECTION 5. LIEN FILING FEE. Chapter 99, Section 08 of the Code of Ordinances of the City of Clinton, Iowa is amended by adding the following sentence thereto: “A lien filing fee of $5.00 shall be added to each utility charge certified to the Clinton County Treasurer.” SECTION 6. WAIVER OF LATE FEES AND PENALTIES UNTIL JANUARY 1, 2006 As the result of the conversion to new sewer billing software, any late fees or penalties relative to sewer rental charges shall be waived until the utility billing process is current sometime in January, 2006. SECTION 7. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION 8. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 9. EFFECTIVE DATE.
