CHAPTER NO. 2297 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF CLINTON, IOWA, 1999 BY AMENDING CHAPTER 10, URBAN REVITALIZATION AREAS TO ALLOW ENTERPRISE ZONE ELIGIBLE BUSINESSES AND OTHER DESIGNATED AREAS TO RECEIVE TAX ABATEMENT BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA:
3. Enterprise Zones. In accordance with Chapter s 404 and 15E of the Code of Iowa, areas designated as Clinton County Enterprise Zones are hereby designated as revitalization areas to provide property tax exemptions for qualified real property improvements involving projects eligible for enterprise zone incentives under Chapter 15E, Code of Iowa. Areas designated revitalization area under this chapter are legally described as follows: Central Clinton Enterprise Zone Commencing as a point of reference at a point on the centerline of 5th Avenue North and North 3rd Street, thence easterly on said centerline of 5th Avenue North to the easterly boundary of the right-of-way of the IC & E Railroad property, thence southerly on the easterly boundary of the right-of-way of the IC & E Railroad to centerline of 4th Avenue South, thence east on said centerline of 4th Avenue South, if extended, to the meander line of the ordinary high watermark of the west side of the Mississippi River, thence southerly on said meander line of the ordinary high watermark of the Mississippi River to the easterly extension of the centerline of Beaver Channel, being a branch of the Mississippi River, thence southwesterly on said centerline of Beaver Channel to the extension of the centerline of Mill Creek where it enters Beaver Channel, south of the City of Clinton Water Pollution Control Plant, thence northerly along the centerline of Mill Creek to the centerline of Beaver Channel Parkway, thence northeasterly on said centerline of Beaver Channel Parkway to the centerline of South 14th Street, thence northerly on said centerline of South 14th Street to the centerline of Camanche Avenue, thence northeasterly on said centerline of Camanche Avenue to the centerline of 11th Avenue South, thence easterly on said centerline of 11th Avenue South to the centerline of South 4th Street, thence northerly on said centerline of South 4th street to the centerline of 4th Avenue South, thence easterly on said centerline of 4th Avenue South to the centerline of South 3rd Street, thence northerly on said centerline of South 3rd Street, and continuing on the centerline of North 3rd Street to the centerline of 5th Avenue South, being the point of beginning. Lincoln Way Enterprise Zone The Northwest Quarter (NW ¼), the Northeast Quarter (NE ¼), and the Southeast Quarter (SE ¼) of Section 24, Township 81 North, Range 5 East of the 5th P.M. and the North One Half (N ½) of the Northeast Quarter (NE ¼) of Section 25, Township 81 North, Range 5 East of the 5th P.M. Business Park Enterprise Zone The Northwest Quarter (NW ¼) of Section 36, Township 82 North, Range 6 East of the 5th P.M. Manufacturing Meadows Enterprise Zone The Northeast Quarter (NE ¼) of Section 5, Township 81 North, Range 6 East of the 5th P.M. and the Northwest Quarter (NW ¼) of Section 14, Township 81 North, Range 6, East of the 5th P.M., and the area described as follows: Commencing at the intersection of Highway 30 and Harrison Drive, thence northeasterly on the Centerline of Harrison Drive to the centerline of 23rd Avenue South, thence west on said centerline of 23rd Avenue South and continuing on the east/west quarter line of Section 14, Township 81 North, Range 6, East of the 5th P.M., to the west line of Section 14, thence south on the west line of Section 14 to the centerline of Highway 30, thence east on the said center line of Highway 30 to the centerline of Harrison Drive, the point of beginning. 4. Section 2. Severability Clause. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. Effective Date.
