CHAPTER NO. 2295

 AN ORDINANCE AMENDING CHAPTER 165.02 OF THE ORDINANCES OF THE CITY OF CLINTON, IOWA, BY CHANGING THE ZONING CLASSIFICATION OF PROPERTY LOCATED AT THE SOUTHEAST CORNER OF 13 AVENUE NORTH AND THE MILL CREEK PARKWAY WITHIN THE CITY OF CLINTON, IOWA, FROM R-1A (SINGLE FAMILY RESIDENTIAL) TO R-4 (APARTMENT RESIDENTIAL).

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA:

 Section 1.  Amendment.  Chapter 165.02 of the Ordinances of the City of Clinton, Iowa, classifying real estate described as follows:

 Part of the northwest quarter of the northeast quarter of Section 2, Township 81 North, Range 6 East of the 5th P.M., City of Clinton, Clinton County, Iowa, more particularly described as follows:

Commencing at the north quarter corner of said Section 2; thence north 87 degrees 25 minutes 19 seconds east along the north line of said northeast quarter, a distance of 50.00 feet; thence south 2 degrees 13 minutes 59 seconds east, a distance of 59.00 feet to the point of beginning at the intersection of the east right-of-way line of North 18th Street and the south right-of-way line of 13th Avenue North; thence following said south right-of-way line of 13th Avenue North north 87 degrees 25 minutes 19 seconds east, a distance of 95.00 feet; thence north 2 degrees 13 minutes 56 seconds west, a distance of 9.00 feet; thence north 87 degrees 25 minutes 19 seconds east, a distance of 747.13 feet to the west line of a parcel described in warranty deed recorded in Deed Book 130 at page 609; thence following the west and south line of said parcel, south 2 degrees 12 minutes 59 seconds east, a distance of 453.00 feet; thence north 87 degrees 25 minutes 19 seconds east, a distance of 433.00 feet to the east line of said northwest quarter of the northeast quarter; thence south 2 degrees 12 minutes 59 seconds east along said east line, a distance of 384.81 feet; thence south 87 degrees 25 minutes 19 seconds west, a distance of 1274.90 feet to the east right-of-way line of North 18th Street; thence north 2 degrees 13 minutes 56 seconds west along said right-of-way line, a distance of 828.81 feet to the point of beginning; said described tract containing 871,200 square feet (20.00 acres), more or less

Is hereby amendment so that said real estate is classified in the R-4 (Apartment Residential) zoning district.

 Section 2.       Repealer.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

Section 3.       Severability Clause.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

Section 4.       Effective Date.  This ordinance shall be in full force and effect from and after its adoption and publication as provided by law.
