CHAPTER NO. 2275 AN ORDINANCE AMENDING CHAPTER 2264 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA: Section 1. Purpose. The City of Clinton and the Iowa Department of Transportation are purchasing property in the Camanche Avenue corridor for the purpose of constructing a new Highway 30/67. In order to facilitate this process, the development moratorium established on April 10, 2001, and extended to March 31, 2004, should be extended to March 31, 2006. Section 2. Amendment. The Code of Ordinances of the City of Clinton, Iowa, is amended as follows: A. Amend Section 165.31 (Amendments) by changing March 31, 2004, to March 31, 2006, in Subsection (5). Section 3. Exceptions. Any person, firm or corporation so aggrieved by or adversely affected by the Planning/Community Development Director’s refusal to issue a permit pursuant to this moratorium shall appeal therefrom to the City Council. The City Counci may direct the Planning/Community Development Director to issue a permit during the moratorium for any work in the Camanche Avenue Corridor which the City Council determines would not negatively impact the redevelopment plan, upon showing good cause by the person, firm or corporation. This moratorium shall not apply to any required repairs that pose a health or safety hazard to the occupants or the general public or to any repair or replacement of any lawful sign as long as the repair or replacement does not change the size, shape or location of the sign. The moratorium shall not apply to any new wall signs placed on existing buildings or any fence. Section 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 5. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 6. Effective Date. This ordinance shall be in full force and effect from and after its adoption and publication as provided by law. ______________________________ LaMetta K.
