CHAPTER NO. 2271

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF CLINTON, IOWA, 1999 BY PROVIDING THAT FEES FOR VARIOUS PERMITS AND SERVICES SHALL BE ESTABLISHED BY CITY COUNCIL RESOLUTION

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA:

Section 1.       Sections modified.  (A)  Chapter 55, Section 21 of the Code of Ordinances of the City of Clinton, Iowa, 1999, is amended by striking the words “as follows” and the fee schedule after it in the third sentence of said section and replacing said words and schedule with “said impoundment fee to be established by city council resolution.”

(B)       Chapter 56, Section 06 of the Code of Ordinances of the City of Clinton, Iowa, 1999 is amended by striking the first and second sentence thereof and the fee schedule after the first sentence and replacing said sentences and schedule with, “The license fees shall be established by city council resolution.

(C)       Chapter 57, Section 05 of the Code of Ordinances of the City of Clinton, Iowa 1999 is amended to read as follows:  “The permit fees shall be established by city council resolution.”

(D)       Paragraph 3 of Chapter 106, Section 06 of the Code of Ordinances of the City of Clinton, Iowa, 1999, is amended by changing the first sentence thereof to read:  “The annual license fee shall be established by city council resolution.”

(E)       Chapter 120, Section 03 of the Code of Ordinances of the City of Clinton, Iowa, 1999, is amended by adding the following sentence, “The inspection/investigation fee shall be established by city council resolution.”

(F)       Chapter 122, Section 05 of the Code of Ordinances of the City of Clinton, Iowa, 1999 is amended by changing the first sentence thereof to read:  “The license fee shall be established by city council resolution.”  Chapter 122, Section 04 of the Code of Ordinances of the City of Clinton, Iowa 1999 is amended by striking the last sentence of said section.

(G)       Chapter 123, Section 01 of the Code of Ordinances of the City of Clinton, Iowa, 1999 is amended by replacing the words “in the amount of fifteen dollars ($15.00)” in the third sentence with “as established by city council resolution.”

(H)      Chapter 126, Section 04 of the Code of Ordinances of the City of Clinton, Iowa, 1999 is amended to read, “The license fees shall be established by city council resolution.”

(I)        Chapter 127, Section 04 of the Code of Ordinances of the City of Clinton, Iowa, 1999 is amended to read, “The license fee shall be established by city council resolution.”

(J)        Chapter 141, Section 03 of the Code of Ordinances of the City of Clinton, Iowa, 1999 is amended to read, “The license fee shall be established by city council resolution.”  Chapter 141, Section 10 of the Code of Ordinances of the City of Clinton, Iowa, 1999, is amended by changing paragraph 1 thereof to read, “1. Fee.  The permit fee shall be established by city council resolution.”

Section 2.       Severability Clause.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

Section 3.       Effective Date.  This ordinance shall be in full force and effect from and after its adoption and publication as provided by law.
