CHAPTER NO. 2263 AN ORDINANCE AMENDING SECTION 69.12 OF CHAPTER OF THE ORDINANCES OF THE CITY OF CLINTON, IOWA 1999 BY ESTABLISHING A PARKING PERMIT SYSTEM FOR OFF-STREET PARKING SPACES AND FOR ON-STREET PARKING SPACES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA: Section 1. Purpose. The purpose of this ordinance is to provide for a parking permit system for certain off-street parking lots and a parking permit system for on-street parking spaces. Section 2. Amendment. Section 69.12 of the Ordinances of the City of Clinton, Iowa, 1999 is hereby amended to read as follows: 69.12 LEASED SPACES. (A) Off-street Parking Lots. No person shall park a vehicle in an off-street parking lot space reserved for parking permit holders except with permission of the reserved permit holder. The City Clerk shall issue 4 month parking permits at a fee to be established by City Council resolution. A sign on a post will be placed in front of each reserved parking space identifying the person/business reserving said parking space. A one-time fee in an amount established by City Council resolution will be charged for the making of the sign and its placement. The number of reserved parking spaces in the off-street parking lots will also be established by City Council resolution. (B) On-Street Parking Spaces. Persons who are handicapped and work in the downtown area may apply for a parking permit allowing them to park in the downtown parking area on-street as long as they want except from 2:00 a.m. to 6:00 a.m. when there is no parking downtown. Application shall be made to the City Clerk’s office for said permit by presenting a state-approved handicap parking permit, a letter from their employer that they are employed downtown and unable to walk from the unrestricted parking lot to the place of employment, and a copy of their driver’s license. The state-approved handicap parking permit and employment status will be reviewed periodically. The administrative fee for issuing said permit and for the monthly fee for said permit shall be established by resolution. The City Clerk shall issue a placard showing on-street parking is permitted. Said placard must be displayed on the dashboard of the vehicle in order for the vehicle not to be issued a parking ticket for parking in excess of the 3 hour limit. The vehicle may be parked on-street in either handicapped parking spaces or regular parking spaces. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 5. Effective Date. This ordinance shall be in full force and effect from and after its adoption and publication as provided by law. ______________________________ LaMetta K.
