CHAPTER NO. 2259

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF CLINTON, IOWA, 1999 ESTABLISHING CALENDAR PARKING AND ESTABLISHING A FINE OF $15.00 PER VIOLATION.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA:

Section 1.       Amendment.  The Code of Ordinances of the City of Clinton, Iowa is amended by amending Chapter 69.14 entitled CALENDAR PARKING, to read as follows:

69.14    CALENDAR PARKING.

Between November 15 and the following March 15, the parking of vehicles on all streets and avenues within the City of Clinton, Iowa, between 12:00 o’clock midnight and 8:00 o’clock a.m., is hereby prohibited except that vehicles may be parked on the even numbered side of a street or avenue on those nights after midnight bearing an even calendar date and on the odd numbered side of a street or avenue on those nights after midnight bearing an odd calendar date and except that where parking is normally permitted on only one side of the street or avenue, vehicles may be parked on that side of the street or avenue only on every night of the week.  No parking shall be permitted where parking is prohibited pursuant to any other ordinances of the City of Clinton, Iowa.  During snow emergencies, calendar parking will be in effect except on streets designated as a snow route where no parking will be permitted until the snow emergency is no longer in effect.  Calendar parking shall not apply to residential handicapped parking spaces.  The fine for a violation of this section shall be $15.00.

Section 2.       Amendment to Snow Emergency Ordinance.  The Code of Ordinances of the City of Clinton, Iowa, 1999, is amended by amending paragraph 1 of Chapter 69.10 entitled Snow Emergency to read as follows:

1.  Parking During Snow Emergency.  When predictions or occurrences indicate the need, the City Administrator or authorized representative shall declare a snow emergency and publicize the same over all radio stations in the city and publish the same in all newspapers in the city.  During a snow emergency, calendar parking will be in effect except on streets designated as a snow route where no parking will be permitted until the snow emergency is no longer in effect.  On those streets where parking is normally permitted on only one side of the street, then vehicles may be parked on that side of the street only except on streets designated as a snow route where no parking will be permitted.

 Section 3.       Repealer.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

 Section 4.       Severability Clause.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

 Section 5.       Effective Date.  This ordinance shall be in full force and effect from and after its adoption and publication as provided by law.
