CHAPTER NO. 2258 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF CLINTON, IOWA, 1999 BY AMENDING PARKING REGULATIONS IN THE DOWNTOWN AREA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA: Section 1. Purpose. The purpose of this ordinance is to: (A) Increase the on-street parking time limit from two (2) hours to three (3) hours. (B) Establish a maximum of three (3) hours in which a vehicle may be parked during any one day in either off-street municipal lot HX, JX, or KX or on-street parking spaces within the defined boundaries. (C) Increase the length of time in which parking violations must be paid from forty-eight (48) hours to seven (7) days. (D) Prohibit the moving of vehicles from one space to another for the purpose of evading time limitations on parking. (E) Eliminate the three (3) hour time limit in municipal off-street parking lot number three (3) located at the northeast corner of Fifth Avenue South and First Street (Masonic Center) and municipal lot number two (2) located between Third Avenue S. and Fourth Avenue S. at Third Street (Clinton Park). (F) Designate only the easterly side of the first row of parking stalls in municipal lot number one (1) between Sixth Avenue S. and Seventh Avenue S. at Third Street to three (3) hour parking (City Hall). (G) Establish a parking ticket validation process whereby businesses may pay for tickets issued to their clients or customers for overtime parking. Section 2. Amendment. Chapter 69 of the City Ordinances is amended by adding the following section 69.14 thereto: SECTION 69.14. DOWNTOWN PARKING REGULATIONS. 1. Overparking Prohibited. No person shall park a vehicle for more than 3 hours during any one day at off-street parking lots HX (4th Ave. S. and S. 2nd St.), lot JX (6th Ave. S. and S. 2nd St.) and Lot KX (200 block 6th Ave. S.). No person shall park a vehicle at an on-street parking space for more than 3 hours during any one day within the downtown parking zone. Any person parking a vehicle in violation of this section shall be subject to a penalty of $5.00. In the event any person receives more than one parking violation for parking a vehicle more than 3 hours in one day, the second and subsequent violations shall be subject to a penalty of $10.00. 2. Downtown Parking Zone Boundaries. The boundaries are as follows: Commencing at the intersection of the south line of 3rd Avenue South with the westerly line of South 4th Street, in the City of Clinton, Iowa, which is the point of beginning; thence easterly along the south line of 3rd Avenue South to the intersection of said south line with the west line of South 1st Street; then southerly along the west line of South 1st Street and vacated South 1st Street to the intersection of said west line with the north line of 8th Avenue South; then westerly along said north line of 8th Avenue South to the intersection of said north line with the westerly line of South 4th Street; then northerly along said westerly line of South 4th Street to the point of beginning; all located in the City of Clinton, Iowa. 3. Parking Fine Increase for Non-payment. The length of time in which parking violations must be paid prior to the fine increasing to $25 is seven (7) days. 4. Parking Limits in Parking Lots at DeWitt Park, Clinton Park and S. 1st Street. All of the municipal off-street parking lots located at the northeast corner of 5th Avenue S. and S. 1st Street, at Clinton Park and at DeWitt Park except the easterly side of the first row of parking spaces at DeWitt Park are hereby designated as 48 hour parking. The easterly side of the first row of parking spaces at DeWitt Park (across from City Hall) are hereby designated as 3 hour parking. 5. Parking Validation Program. Businesses may purchase numbered validation stamps at Clinton City Hall for a discounted fee of $25.00 for a book of 10 self-adhesive stamps or $50.00 for a book of 20 self-adhesive stamps. Each stamp represents payment for one $5.00 violation. Stamps can be used for customer or client parking validation only. When a customer or client of a participating business is parked over the allowable parking time limit and is subsequently issued a ticket, the participating business may attach to the backside of the ticket a validation stamp thereby validating the ticket and negating the penalty. The customer or client must then either deposit the ticket in a City of Clinton designated parking violation box, deliver the ticket to City Hall in person or mail the ticket to the City of Clinton, 611 S. 3rd Street, Clinton, Iowa 52732. The (Pv) validation symbol in the windows of businesses indicates participating companies. Parking validation window signs are available at Clinton City Hall. Employee use of validation stamps for the purpose of negating parking penalties that employees have incurred will result in suspension of the offending business validation privileges. The City Administrator shall establish the necessary procedures to implement this program. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 5. Effective Date.
