CHAPTER NO. 2256

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF CLINTON, IOWA BY AMENDING CHAPTER 165, ZONING REGULATIONS, BY ADDING AN APPEARANCE CODE FOR NEW COMMERCIAL BUILDING AND AMENDING THE ACCESSORY BUILDING REGULATIONS.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA:

Section 1.   Section Modified.  The Code of Ordinances of the City of Clinton, Iowa, is amended as follows:

Amend Section 165.22 by adding a new subsection:

15. Building Appearance Standards.  All buildings, except single-family homes and residential accessory buildings, fronting on a public roadway in any C-1, C‑2, C-2M, C-3, C-4 or C-R Commercial Zoning District, shall follow the requirements this subsection:

                        A.        In order that buildings, structures and landscaping elements will be in harmony with other structures and improvements in the City, the following building standards shall apply to all new construction. 

                                    (1)        For all new construction, the preferred exterior building materials shall include, but are not limited to brick or other suitable clay masonry material, stone veneer, granite, cast in place concrete panels, finished faced precast concrete, ceramic tile, decorative concrete block and tinted glass.

                        B.         New construction not meeting the requirements of subsection A(1) above shall have the front exterior meet the following standards:

                                    (1)        The front exterior of a new building shall have as a facing material on a minimum of 30 percent of the gross wall area from the eave or coping line down to grade line one of the preferred materials listed in Section 2(A), glazed tile, wood, glass or an approved equivalent.

                        C.        Buildings on corner lots shall follow these requirements for both street frontages.

                        D         Material  guidelines:

                                    (1)        Material used shall be selected for suitability to the type of building or design in which they are used.

                                    (2)        Materials shall have good architectural quality and character.

                         E.         Exceptions

                                    (1)        Buildings completely screened by other buildings from a public street or not clearly visible from a public street shall be exempt from these requirements.

                         F.         In the event that a dispute arises as to which wall constitutes the front of a building, the decision shall be made solely by the Zoning Committee of the City Plan Commission by considering what the general public would regard as the front of the building.  The Zoning Committee will also determine alternative facing material than those specified in this section.

Section 2.   Section Modified.  The Code of Ordinances of the City of Clinton, Iowa, is amended as follows:

 Amend Sections 165.11, 165.12, 165.13 and 165.14 by adding a new subsection to each section:

 5.         All new construction/additions shall meet the requirements of Section 165.22(15).

Section 3.   Section Modified.  The Code of Ordinances of the City of Clinton, Iowa, is amended as follows:

Amend Section 165.15 by adding a new subsection:

 6.         All new construction/additions shall meet the requirements of Section 165.22(15).

 Section 4.   Section Modified.  The Code of Ordinances of the City of Clinton, Iowa, is amended as follows:

 Amend Section 165.22 (7) (A) shall be amended to read:

             Accessory buildings must be in a rear or side yard and shall not occupy more than 30 percent of a rear yard.  In all “R” Districts, except the R-1A District, the aggregate ground cover of all accessory buildings shall not exceed 1,000 square feet in floor area.  In addition, 1 yard shed, not exceeding 160 square feet in floor area, is allowed.  All accessory buildings, except yard sheds, shall be constructed of materials that are the same or similar to the principle building.
 

Section 5.   Repealer.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

Section 6.   Severability Clause.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. 

Section 7.  Effective Date.  This ordinance shall be in full force and effect from and after its adoption and publication as provided by law
