CHAPTER NO. 2255

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF CLINTON, IOWA, 1999 BY AMENDING PROVIDIONS RELATING TO ZONING BOARD OF ADJUSTMENT MEMBERSHIP AND HEARING NOTICE REQUIREMENTS.

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA:

 Section 1.       Zoning Board of Adjustment membership requirements modified.  Chapter 165, Section 27, of the Code of Ordinances of the City of Clinton, Iowa, 1999, is amended by repealing the last sentence of paragraph 1 and the following sentence adopted in lieu thereof:

 “A majority of the members of the Zoning Board of Adjustment shall be persons representing the public at large and shall not be involved in the business of purchasing and selling real estate.”

Section 2.       Special Use Permit appeal notice requirements.  Chapter 165, Section 28 of the Code of Ordinances of the City of Clinton, Iowa 1999 is amended by repealing the last sentence of paragraph 2.A. and the following sentence adopted in lieu thereof:

 “A public hearing shall be held in relation to said plan before the Zoning Board of Adjustment, notice and publication of the item and place for which shall conform to the procedure prescribed in Section 165.27, paragraph 6.”

Section 3.       Severability Clause.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

 Section 4.       Effective Date.  This ordinance shall be in full force and effect from and after its adoption and publication as provided by law.
