CHAPTER NO. 2250

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF CLINTON, IOWA, 1999 BY ESTABLISHING THE BOUNDARIES OF THE WARDS AND THE BOUNDARIES OF THE VOTING PRECINCTS IN THE WARDS IN THE CITY OF CLINTON, IOWA, AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA:

Section 1. That the First Ward in the City of Clinton, Iowa shall be bounded as follows:

First Ward – First Precinct

All that part of the City of Clinton, Iowa bounded as follows:

Beginning at the intersection of the centerlines of South 10^th Street and 11^th Avenue South;

Thence east on said centerline of 11^th Avenue South to the centerline of South 9^th Street;

Thence north on said centerline of South 9^th Street to the centerline of 10^th Avenue South;

Thence east on said centerline of 10^th Avenue South to the centerline of South 8^th Street;

Thence north on said centerline of South 8^th Street to the centerline of 9^th Avenue South;

Thence east on said centerline of 9^th Avenue South to the centerline of South 6^th Street;

Thence north on said centerline of South 6^th Street to the centerline of 6^th Avenue South;

Thence east on said centerline of 6^th Avenue South to the centerline of South First Street;

Thence north on said centerline of South First Street to the centerline of 4^th Avenue South;

Thence east on said centerline of 4th Avenue South and the easterly extension thereof to the east city limits, being the thread of the main channel of the Mississippi River;

Thence west on said centerline of 19th Avenue South to the intersection of 19th Avenue South and the Union Pacific Railroad tracks;

Thence southwesterly along said Union Pacific Railroad tracks to the southeasterly extension of the centerline of 18th Place;

Thence northwesterly on said southeasterly extension and centerline of 18th Place to the centerline of Camanche Avenue;

Thence easterly on said centerline of Camanche Avenue to the centerline of 16th Place;

Thence northwesterly on said centerline of 16^th Place to the centerline of 15^th Avenue South;

Section 2. That the Second Ward in the City of Clinton, Iowa shall be bounded as follows:

Second Ward – First Precinct

All that part of the City of Clinton, Iowa bounded as follows:

Beginning at the intersection of the centerlines of 2^nd Avenue South and Thorwaldsen Place;

Thence east on said centerline of 2^nd Avenue South to the centerline of South 6^th Street;

Thence north on said centerline of South 6^th Street to the centerline of First Avenue;

Thence east on said centerline of First Avenue to the centerline of Fayette Street;

Thence north on said centerline of Fayette Street to the centerline of 3^rd Avenue North;

Thence east on said centerline of 3^rd Avenue North to the centerline of North 2^nd Street;

Thence north on said centerline of North 2nd Street to the centerline of 4^th Avenue North;

Thence east on said centerline of 4^th Avenue North to the intersection of 4^th Avenue North and an unnamed road through Riverview Park;

Thence south on said centerline of Kennilworth Court to the centerline of 7^th Avenue South;

Thence west along said centerline of US Highway 30 to the centerline of County Road 380^th Avenue, the point of beginning which is not included in the City of Clinton, Iowa but as agreed to by the City of Clinton Iowa and Clinton County, Iowa shall be included in Ward 2, Precinct 2 for voting purposes in certain elections.

Section 3. That the Third Ward in the City of Clinton, Iowa shall be bounded as follows:

All that part of the City of Clinton, Iowa bounded as follows:

Thence east on said centerline of 17th Avenue North to the centerline of North 3rd Street;

Thence north on said centerline of North 3rd Street to the centerline of 21^st Avenue North;

Thence east on said centerline of 21^st Avenue North to the east city limits, being the thread of the main channel of the Mississippi River;

Thence southerly on said east city limits line to the easterly extension of First Avenue;

Thence west on said centerline of First Avenue to the intersection of First Avenue and an unnamed road through Riverview Park;

Thence northwesterly along said unnamed road through Riverview Park to the centerline of 4th Avenue North;

All that part of the City of Clinton, Iowa lying between 13th Avenue North and 2nd Avenue South, and bounded on the west by the west city limits and on the east by the following described lines:

Commencing at the intersection of the centerlines of 13th Avenue North and Springdale Drive;

Thence southeasterly on said centerline of Springdale Drive to the centerline of Bluff Blvd;

Thence northeasterly on said centerline of Bluff Blvd to the centerline of 6^th Avenue North;

Thence east on said centerline of 6^th Avenue North to the centerline of North 5^th Street;

Thence south on said centerline of North 5^th Street to the centerline of 3^rd Avenue North;

Thence west on said centerline of 3^rd Avenue North to the centerline of Fayette Street;

Thence east on said centerline of 26th Avenue North to the centerline of Pershing Blvd;

Thence north on said centerline of Pershing Blvd to the centerline of 28^th Avenue North;

Thence east on said centerline of 28^th Avenue North to the centerline of Roosevelt Street;

Thence north on said centerline of Roosevelt Street to the centerline of 29th Avenue North;

Thence east on said centerline of 29^th Avenue North to the centerline of Garfield Street;

Thence north on said centerline of Garfield Street to the centerline of 30^th Avenue North;

Section 5. Repealer. Any ordinance or parts of ordinances in conflict herewith are hereby repealed. Specifically repealed is Chapter No. 2244 of the Ordinances of the City of Clinton, Iowa.

Section 7. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

Section 7. Effective Date. This ordinance shall be in full force and effect from and after its adoption and publication as provided by law. This ordinance will apply to persons elected in the November 4, 2003, Municipal Elections that will take office on January 2, 2004.
