CHAPTER NO. 2248

AN ORDINANCE AMENDING CHAPTER 2097 OF THE ORDINANCES OF THE CITY OF CLINTON, IOWA BY AMENDING THE HEIGHT STANDARDS FOR WIRELESS COMMUNICATIONS FACILITIES

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA:

Section 1.       Amendment.  Section V(A)  2) of Chapter 2097 of the Ordinances of the City of Clinton, Iowa is hereby amended to read as follows:

2)      Wireless Communications Facilities with Support Structures shall have a maximum height of 190 feet.  Variances to this maximum height restriction may be granted by City Council resolution.  The maximum height standards in Appendix A are hereby deleted.

 Section 2.       Repealer.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

 Section 3.       Severability Clause.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

 Section 4.       Effective Date.  This ordinance shall be in full force and effect from and after its adoption and publication as provided by law.
