CHAPTER NO. 2246

 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF CLINTON, IOWA 1999, BY INCREASING THE HOTEL AND MOTEL TAX FROM A RATE OF 5% TO A RATE OF 7%

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA:

Section 1.       Section Modified.  Chapter 129.02 of the Code of Ordinances of the City of Clinton, Iowa, 1999 is repealed and the following adopted in lieu thereof:

129.02  TAX IMPOSED.  A tax is hereby imposed upon the gross receipts from the renting of any and all rooms, apartments or sleeping quarters in any hotel or motel as defined in this chapter at the rate of seven percent (7%) of such gross receipts derived from the renting of a room, apartment or sleeping quarters while rented by the same person for a period of not more than 31 consecutive days.

Section 2.       Effective Date of Tax.  The tax hereinabove established shall be imposed only after an election to be held on November 6, 2001, at which a majority of those voting on the question favor the imposition of such tax.  In the event that the tax is approved at said election, the tax shall then be imposed on April 1, 2002, pursuant to Chapter 422A of the Code of Iowa (1999).  The City Clerk is directed to forward a certified copy of this ordinance to the Commissioner of Elections to accompany said question on the ballot.

Section 3.       Severability Clause.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

 Section 4.       Repealer.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
